We highly value the privacy of our users. CarCollect B.V. (hereinafter ‘CarCollect’, ‘us’, ‘we’ or ‘our’) therefore explains in this privacy statement (hereinafter ‘Privacy Statement’) how we handle your personal data.

CarCollect processes your personal data in accordance with applicable Dutch privacy laws and regulations, including the General Data Protection Regulation (GDPR).

This Privacy Statement applies to the website www.carcollect.com (hereinafter: the “Website”). CarCollect operates in different ways when processing data:

  • We act as data controller when you use our services or communicate with us. We use the data we collect in this context, among other things, to provide our services to you or contact you;
  • We act as a processor when our customers use our service to store personal data of third parties. In this case, our customer determines the purpose of the data processing and acts as a data controller. The customer determines which third-party personal data it provides to us and is responsible for informing the relevant third parties accordingly.

Who is responsible for the processing of personal data?

The controller of the processing of personal data as stated in this Privacy Statement is CarCollect B.V., with its registered office and place of business at Bovendonk 15, 4707 ZH in Roosendaal and registered in the Trade Register of the Chamber of Commerce with number 22039448.

Which personal data do we collect?

We may collect the following personal data from you:

  • Elementary personal data (including name, address, phone number, email address);
  • Financial data (including billing addresses, bank account number);
  • Device information (including internet browser, device type, IP address);
  • Geolocation;
  • Electronic network activity;
  • Correspondence.

We also collect additional personal data and information that you share with us on your own initiative.

For what purposes and on what grounds do we collect personal data?

We collect personal data for the following purposes:

  • To provide our service. We process customer data necessary to provide our services and allow customers to use the CarCollect platform. The basis for this processing is the performance of the agreement we have concluded with the customer.
  • To inform about updates in our service. If you are a customer of ours, we may send emails with important updates in our service or changes in our terms and conditions. The basis for this processing is the performance of the agreement we have concluded with each other.
  • To keep our Website functioning and secure. In order to make our Website function properly and secure, we use data about the device you use to visit our Website. The basis of this processing is performance of the agreement or legitimate interest.
  • To optimise our service. We process data on geolocations, electronic network activity and device information to optimise our CarCollect platform and its promotion. The basis for this is legitimate interest.
  • To send newsletters via e-mail. On the Website, you can sign yourself up for our newsletters. The basis of this processing is permission. You can withdraw this permission at any time if you no longer wish to receive the newsletter.
  • To process requests submitted to our support department. When you contact us, we collect the data necessary to process your request. For this we need at least your basic data. The basis of this processing is performance of the contract if you are a customer or supplier of ours. If we have not (yet) concluded a contract with each other, the basis is legitimate interest.

Not all data we collect for the above purposes qualify as personal data as defined in the GDPR. Only when we collect data that can be directly or indirectly traced to a person do we refer to it as personal data. It is therefore possible that in the above activities in your case no personal data are collected by us.

Who has access to your personal data?

Only CarCollect employees whose job requires them to have access to your personal data can view it.

Furthermore, we never disclose your personal data to third parties without your consent, unless we are obliged to disclose your personal data under a legal provision.

Do we share your personal data with processors?

We share your personal data with third parties that we engage as processors. These parties never use the personal data we share with them for their own purposes. In addition, we conclude processing agreements so that we comply with relevant privacy legislation and your personal data are safe. Furthermore, we do not share your personal data with others, unless we are legally obliged to do so.

Do we share your personal data outside the EEA?

We sometimes transfer your personal data outside the European Economic Area (EEA), for example because a processor of ours is based or uses servers outside the EEA. In this case, we always ensure that we make proper arrangements so that your personal data is protected at a level that complies with European standards, including the GDPR.

How long do we keep your personal data?

We never keep your personal data longer than necessary for the purposes mentioned above.

We keep personal data stored in customers' accounts on the CarCollect platform for as long as the account is active. If the account is cancelled, personal data will be deleted from the account after 3 months or anonymised.

If you have given us permission to send newsletters, we will retain your personal data until you withdraw this permission.

How do we secure your personal data?

We ensure appropriate technical and organisational measures to secure your personal data against loss and against any form of unlawful processing. In addition, we have a good firewall and carefully monitor network traffic.

All connections to the CarCollect web, smartphone and tablet application or the API link go through a secure SSL connection. Users' passwords are stored securely, using hashing algorithms.

It is also possible within the CarCollect platform to grant or deny users access to specific parts, so that users only get insight into the data they need.

Which privacy rights do you have?

Under the terms of the GDPR, you have several privacy rights. Below, we explain which rights these are and how you can make use of them:

  • Right to access: you have the right to know what personal data we hold about you;
  • Right to rectification: you can submit a request to amend your personal data if it has been changed;
  • Right to deletion: you have the right to have the personal data we hold about you deleted;
  • Right to object: you can object to the processing of your personal data;
  • Right to restriction: you have the right to make a request to temporarily stop processing your data;
  • Complaints: you also always have the right to file a complaint with the national privacy regulator, the Personal Data Authority, if you have a complaint about the way we handle your personal data.

Exercising rights

To exercise these privacy rights, please send an e-mail to support@carcollect.com. To verify that a request was actually made by you, in addition to sending an e-mail from the e-mail address we hold for you, you should confirm the request by telephone using the telephone number we hold for you.

After receiving the request, we will respond within 4 weeks. If we need more time to process your request, we will inform you accordingly.

Automated decision-making

We do not use automated decision-making without human intervention to make decisions that may (significantly) affect you as an individual.

CarCollect may amend this Privacy Statement. Please consult the Website for the current version of the Privacy Statement.

To collect data in Google Tag Manager and Google Analytics 4, we place JavaScript tracking code on our Website that sends information to Google servers, including those in the United States. Please read Google's privacy policy for more information. If you do not want to be included in our Google Analytics statistics, you can use the Google Analytics Opt-out Browser Add-on.

Buttons on the Website make it possible to share parts of this Website on various social media. These buttons come from these social media companies themselves, including YouTube and LinkedIn.
